Terms of Service

1. Acceptance of Terms

By accessing and using DropScout ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

DropScout is an intelligent product tracking platform that specializes in monitoring inventory availability across indie toy stores, collectible shops, limited-run merchandise sites, fashion microbrands, artist stores, and creator launches. Our service provides automated stock monitoring, real-time notifications, drop tracking for boutique retailers, and a browser bookmarklet tool for one-click product tracking. We provide this service on an "as is" basis.

3. User Accounts and Registration

Account Creation

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious content
  • Attempt to gain unauthorized access to our systems
  • Use the service for commercial reselling without permission
  • Overwhelm our servers with excessive requests

5. Service Limitations and Availability

Service Accuracy

While our AI-powered system includes confidence scoring, error recovery, and adaptive monitoring to maximize accuracy, we cannot guarantee that all product availability information is current or accurate. Inventory data depends on third-party retailer websites and may be affected by anti-bot measures or website changes.

Store Compatibility

DropScout is optimized for indie stores, boutique retailers, and small-to-medium online shops. We may limit or restrict monitoring of large retail chains that implement aggressive anti-bot protection or violate our service focus.

Service Interruptions

We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice. We are not liable for any interruptions or downtime.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by DropScout and are protected by international copyright, trademark, and other intellectual property laws.

Third-Party Trademarks

All product names, logos, and brands mentioned in our service are property of their respective owners. We are not affiliated with or endorsed by these companies.

7. Bookmarklet Tool

Functionality

Our browser bookmarklet provides one-click product tracking functionality. By using the bookmarklet, you authorize DropScout to access the product page you're currently viewing for the purpose of extracting product information.

Usage Requirements

  • You must be logged into your DropScout account
  • The bookmarklet should only be used on product pages from supported retailers
  • You are responsible for using the bookmarklet in compliance with third-party website terms

Data Collection

The bookmarklet only collects product information (title, price, URL) from pages where you explicitly activate it. It does not track your browsing activity or collect data in the background.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding personal information, bookmarklet data collection, and third-party service integration.

9. Subscription Plans and Billing

Service Tiers

DropScout offers multiple service tiers: Free (basic tracking), Plus ($5/month for enhanced features), and Pro ($15/month for premium capabilities with faster monitoring). Billing occurs monthly on a recurring basis through our payment processor, Stripe.

Features and Limitations

Each tier includes different monitoring frequencies, tracking limits, and notification options. Tier-based polling intervals ensure optimal performance across all service levels.

Billing and Payment

  • Subscriptions automatically renew unless cancelled before the renewal date
  • Payment is due at the beginning of each billing cycle
  • Failed payments may result in service suspension
  • You are responsible for keeping payment information current

Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation will take effect at the end of your current billing period. No partial refunds are provided for unused portions of billing periods.

10. Refund Policy

General Refund Policy

All sales are final. We do not offer refunds for subscription fees, except in the limited circumstances outlined below.

Eligible Refund Circumstances

Refunds may be considered only in the following situations:

  • Billing Errors: Unauthorized charges or duplicate billing
  • Technical Failures: Complete service unavailability for more than 48 consecutive hours due to our system failures
  • Account Creation Errors: Accidental account creation or upgrade within 24 hours of purchase

Refund Process

  • Refund requests must be submitted within 7 days of the charge
  • All refund requests must be sent to support@dropscout.ai with detailed explanation
  • Refunds, if approved, will be processed within 5-10 business days to the original payment method
  • Chargebacks or payment disputes will result in immediate account termination

Non-Refundable Services

The following are explicitly non-refundable:

  • Partial billing periods for cancelled subscriptions
  • Services used for any period before cancellation
  • Dissatisfaction with tracking accuracy or website compatibility
  • Third-party website changes that affect monitoring capability
  • Account suspension due to terms violation

11. Disclaimers and Limitation of Liability

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We expressly disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding the accuracy, reliability, or completeness of product tracking data
  • Warranties that the service will be uninterrupted, timely, or error-free
  • Warranties regarding the compatibility with third-party websites or services

Service Accuracy Disclaimer

While DropScout employs intelligent automated monitoring and achieves approximately 90%% accuracy on small-medium stores, we cannot guarantee:

  • That all product availability information is current or accurate
  • That notifications will be delivered without delay
  • That third-party website changes won't affect monitoring capability
  • That tracked products will remain available when you attempt to purchase

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DROPSCOUT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  • Direct Damages: Exceeding the amount paid by you for the Service in the 12 months preceding the event giving rise to liability
  • Indirect, Incidental, Special, or Consequential Damages: Including but not limited to lost profits, lost data, business interruption, or missed purchase opportunities
  • Third-Party Actions: Damages arising from third-party website changes, anti-bot measures, or service interruptions
  • Technical Issues: Damages from service downtime, notification delays, or monitoring failures
  • Data Loss: Loss of tracking configurations, notification preferences, or account data

Maximum Liability Cap

Our total liability to you for all claims relating to the Service shall not exceed the total amount paid by you to DropScout in the 12 months immediately preceding the event giving rise to liability, or $100, whichever is less.

Acknowledgment

You acknowledge that the fees charged for the Service reflect this allocation of risk and that DropScout would not provide the Service without these limitations.

12. Indemnification

You agree to indemnify and hold harmless DropScout from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use constitutes acceptance of modified Terms.
